Why Med-Spa Insurance Is More Complex

A medical spa performs services regulated differently than a traditional nail salon or barbershop. Botox, fillers, laser treatments, chemical peels, microneedling, and body contouring procedures all carry higher risk profiles — and require specific professional liability coverage that general business insurance does not provide.

In New York, the regulatory environment for med-spas has tightened significantly since 2022. Services involving medical-grade treatments must be supervised by a licensed physician, nurse practitioner, or other medical professional — and the insurance structure must reflect this supervision relationship. A standard BOP is not sufficient for most med-spa operations.

Required Coverage for New York Med-Spas

1. General Liability

Covers premises liability — slip-and-fall, property damage, and non-professional liability claims. Required by most commercial landlords in Nassau County and NYC. Many NYC leases require $2M per occurrence minimum.

2. Professional Liability / Medical Malpractice

This is the critical coverage that standard GL does not provide. Professional liability for med-spas covers claims arising from professional services performed — an adverse reaction to filler, a laser burn, a botched cosmetic procedure. The right policy depends on: what services you offer, who performs them, what their license level is, and how the supervising physician relationship is structured. This is highly specific to each med-spa — we discuss each case individually.

3. Business Owners Policy

GL plus property coverage for your equipment, inventory, and tenant improvements. Med-spa equipment — laser devices, RF machines, microneedling equipment — can have significant replacement value. Make sure your property coverage limits reflect actual replacement cost.

4. Workers Compensation

Required by NY State for any employees. Med-spa staff — estheticians, nurses, laser technicians — are employees under NY law regardless of how they are paid.

The Supervision Gap

New York law requires that certain med-spa services be performed under physician supervision. If your insurance structure does not match your actual supervisory relationship, you may have an uncovered claim when it matters most. Brow Bars, Lash Studios and Aesthetic Services

Brow bars, lash extension studios, waxing services, and non-medical aesthetic businesses do not require the same medical professional liability structure as med-spas, but they do need professional liability in addition to their GL. Claims for allergic reactions to lash adhesive, brow tinting errors, or wax burns are common and typically excluded from standard GL policies.
